THE CONTRACT BETWEEN US

These Terms & Conditions of the Sale of Goods apply to all transactions between us Atelier Fifty Five, and any sale of goods by Atelier Fifty Five to you. Please read them carefully. Atelier Fifty Five reserves the right to change these Terms & Conditions of the Sale of Goods from time to time by updating this page. Orders placed by you are an offer to purchase and a contract is only formally created once your offer to purchase is accepted by us, and the designer in question. You will receive an email confirmation from us once your order has been accepted. These terms and conditions, together with the prices displayed on our website, delivery details, contact details, and any document expressly referred to in these Terms & Conditions of the Sale of Goods, set out the whole of our agreement relating to the sale of goods by us to you. These Terms & Conditions of the Sale of Goods do not affect your statutory rights.

PRODUCT INFORMATION AND AVAILABILITY

Each product purchased is sold subject to its product description. The information, including all drawings, images, descriptive material, specifications and advertising on our website are for the sole purpose of giving an approximate description of the goods in order to assist your purchasing decision. Unless otherwise stated all products are dispatched directly from the designers.

As such all goods advertised are strictly subject to availability. We aim to keep the website as up to date as possible, however, all information, including product descriptions, appearing on this website at any given time may not always reflect the position at the time you place an order. Every effort is made to ensure that all the information on our website is correct at the time of viewing. Atelier Fifty Five shall not be liable for any direct or indirect or consequential loss arising from any inaccurate image or description.

PRICES AND CANCELLATION BY US

The price payable for goods will be stipulated on our website at the time you place your order. The total cost of your order is the price of the goods ordered plus delivery. The prices shown are in UK sterling (GBP) and are inclusive of VAT. For addresses outside the UK and Ireland, the final price for overseas customers will be calculated in accordance with the applicable exchange rate on the day your debit/credit card company processes the transaction. Any delivery charges are extra. All orders are subject to stock availability. We reserve the right to cancel your order if 
- there is insufficient stock to deliver the goods you have ordered; or 
- we do not deliver to your area or cannot find a cost-effective postal carrier to do so; or 
- one or more of the goods you ordered was listed at an incorrect price due to a typographical error; or 
- your payment is not authorised or is refused. If we discover an error relating to your order, we will contact you as soon as possible to advise you of the error and confirm that you still wish to proceed. If we do cancel your order, we will notify you by e-mail and we will re-credit to your account any sum debited by us from your credit card within 30 days of your order. We are not obliged to offer any additional compensation for inconvenience or disappointment suffered.

DELIVERY OF GOODS TO YOU

We will deliver the goods you have ordered to the address you provide us with for delivery at the time you make your order. Unless stated otherwise all products are dispatched directly from the designers to you. Every effort will be made to deliver your goods within the times specified in the Delivery information page but delayin delivery is sometimes outside of our or the dispatcher’s control. Any dates we give you for delivery are approximate only and we shall not be liable for any losses, costs, damages, charges, or expenses caused by any delay in delivering the goods to you. You will become the owner of the goods you have ordered once they have been delivered to your specified delivery address and your payment has been authorized and cleared by the credit card company. Once the goods have been delivered we no longer have any responsibility for any loss or damage to the goods. Digital goods will be available for download soon after payment, unless stated otherwise, and no physical product will be shipped. Orders being shipped to you from outside your country of residence may be subject to the relevant import taxes, customs duties and fees of the destination country, which is the responsibility of the purchaser. Atelier Fifty Five is not liable for any such taxes, duties or fees. We do not currently offer a dedicated delivery service to addresses outside of the UK and Ireland, Europe or North America. If your delivery address is outside of the UK and Ireland, Europe or North America and you would like to place an order for a product please contact us at shop@atelierfiftyfive.com to discuss suitable delivery options, which may take longer than 28 days.

 

CANCELLATION BY YOU

You may cancel your order within 24 hours of placing your order. You do not need to give us a reason for cancelling your order nor will you have to pay any penalty. After which time if you order has already been processed or you have already received the goods you may cancel your order by returning the goods you have ordered within 14 days after they are delivered. The only circumstance in which you cannot cancel your order is where you have taken the goods you have ordered (or the ones in relation to which you want to cancel) out of the sealed package in which they were delivered. To cancel your order you must notify us by writing to the following email shop@atelierfiftyfive.com. If you have received the goods before you cancel your order then, unless you have lost your right to cancel because you have taken the goods out of their sealed package, you must send them back to the address that will be supplied at your own cost and risk. If you cancel your order but we have already processed the goods for delivery you must not unpack the goods when you receive them and you must send the goods back to us at our supplied contact address at your own cost and risk as soon as possible. Once you have notified us that you are cancelling your order, any sum debited by us from your credit card will be re-credited to your account as soon as possible and in any event within 30 days of your order provided that the goods in question are returned by you and received by us in the condition they were in when delivered to you.

RETURNS AND EXCHANGES

Atelier Fifty Five and the designers we partner with will accept the return of any items that you are not completely happy with when you return it to us in saleable condition by post within 14 days of receipt. Refunds will be credited to your original method of payment. We cannot offer refunds on pierced jewellery for hygiene reasons, or on goods made to order unless the goods we deliver are not what you ordered, or are damaged or defective, or the delivery is of an incorrect quantity. In those instances our only obligation will be: 
- to make good any shortage; or 
- to replace or repair any goods that are damaged or defective; or 
- to refund to you the amount paid by you for the goods in question. Our maximum liability to you arising from any product you purchase from us shall be the price you paid for the product. To arrange a refund or exchange your order you must notify us first by writing to the following email shop@atelierfiftyfive.com. When returning goods we recommend using recorded post and retaining Proof of Postage as we do not accept responsibility for items lost, delayed or stolen in transit, and to the extent permitted by law, we shall not be liable to you for any indirect or consequential loss or damage that is caused by any event or circumstance beyond our reasonable control, which shall include, but not be limited to, acts of God, civil commotion, riots, flood, drought, fire, and legislation.

Digital Goods

Due to the unphysical nature of digital items they cannot be returned or exchanged. If you have any problems with your digital product please contact us at email shop@atelierfiftyfive.com and we will endeavour to do our best to sort out the issue. Our cancellation policy does not apply to digital goods as download links are sent instantly.

LATE OR LOST ITEMS

Items to be delivered within the UK and Ireland will be sent primarily by Royal Mail or courier. Items sent internationally may either be sent through the Royal Mail International Standard or Economy service or another suitable postal carrier. Once your items are placed by us with the relevant postal carrier, we are no longer liable for those items and in the event that they are late, lost or stolen, it is with that relevant postal carrier that any liability for late, lost or stolen items will lie. Atelier Fifty Five will however, endeavour to make all reasonable efforts to assist you in tracking down your items so that they are delivered to you. If you do not receive goods ordered by you within 30 days of the date on which you ordered them, or up to 40 days if your delivery address is outside of the UK and Ireland, Europe or North America we shall have no liability to you unless you notify us in writing at our supplied contact address of the problem within 40 days, or 60 days if your delivery address is outside of the UK and Ireland, Europe or North America of the date on which you ordered the goods.

RESALE

Members of the public are not allowed to purchase our goods with the specific intent of reselling them in any country without our prior agreement to be obtained in writing. If you are a trade customer including retailer please contact shop@atelierfiftyfive.com to receive the relevant information.

THE LAW GOVERNING THIS CONTRACT 
All contracts are conducted in English and by entering into a contract both parties agree to submit to the sole jurisdiction of the courts of England and Wales, in accordance with English law. All of the above does not affect your statutory rights.

  • Eight years ago I started a blog as a place to document the interesting things I was discovering with regards to the design and creativity emerging from Africa. From the moment I created my first blog post little did I know where the journey would take me. Fast-forward to present day I have not only been privileged to witness the development of an industry, but to also have an active role in creating awareness about it.

On this journey, I have seen Africa’s design industry grow from a handful of names from a handful countries to a continent wide-reach. Some names that were just starting out have become internationally respected leaders in their field, whilst behind them, a new generation of names are coming up and claiming their place in the industry.

To say that it is an exciting time for African design and creativity would be a gross understatement! We are in a time of rapid advancement and unbridled creative expression, that is setting the foundations and standards for future generations to build on. And like many other emerging industries in Africa, creativity is opening up opportunities to those who are willing to seize them. And seizing them designers are!
